Define the Material Scope of GDPR

Applies to the processing of personal data wholly or partly by automated means and to the processing of personal data which form part of a filing system or are intended to form part of a filing system. 

The GDPR does not apply:

  • For activities outside the scope of EU law;

  • By a natural person in the course of a personal or household activity;

  • For the purposes of prevention, investigation, detection or prosecution of criminal offenses;

The following option are the fines contained in the German IT Security Law (IT Sicherheitgessetz)

a.      Fines up to 10 000 000 EUR or in the case of an undertaking, up to 2% of the worldwide annual revenue of the prior financial year, whichever results higher. Fines up to 20 000 000 EUR or in the case of an undertaking, up to 4% of the worldwide annual revenue of the prior financial year, whichever results higher.

b.      Fines up to 10 000 EUR for no cooperating with the law enforcement authorities.

c.       Both a fine of 500 000 EUR and an imprisonment of up to two years.

d.      Up to 50 000 EUR for telemedia service providers and up to 100 000 EUR for operators of critical infrastructure.

e.      The fines are calculated on the basis of the existent minimum weight salary of the country concerned.

Information Notices: The data subject has the right to receive information about the processing of his/her personal data from the data controller, containing at least 14 types of information, including (but not limited to):

  • the identity and contact details of the controller

  • the contact details of the data protection officer

  • the purposes for data processing

Access: The data subject has the right to obtain confirmation from the data controller as to whether or not his/her personal data are being processed, as well as gain access to that data.

Rectification: The data subject has the right to obtain from the controller the rectification of his/her personal data that are inaccurate, without undue delay.

Erasure: The data subject has the right to obtain the erasure of his/her personal data from the controller without undue delay, in any of the following situations:

  1. the purpose of data collection has been fulfilled; data collection is no longer necessary

  2. the data subject withdraws consent and there is no other legal justification for the collection

  3. there is no overriding grounds for processing or the data subject objects to the processing of personal data

  4. the personal data has unlawfully been processed

  5. the erasure of data is required for compliance to the EU or Member State law where the controller belongs to

  6. the personal data have been collected in relation to the offer of information society services

Briefly explain the scope of the Budapest Convention and its Additional Protocol on Xenophobia and Racism.

The Budapest Convention is the first and only international treaty on crimes committed through the Internet and computer systems and networks. Its goal was to pursue a common criminal policy aimed at the protection of society against cybercrime, by adopting appropriate legislation and fostering international co-operation.

The crimes that were in scope included: computer and system attacks, interception and illicit access to computer systems, computer fraud, computer falsification, copyright, child pornography and identity theft.

Main provisions: it establishes powers, attributions and procedures so that the investigating authorities of the criminal justice system have the necessary tools to combat cybercrime and access electronic evidence more effectively.

The Additional Protocol on Xenophobia and Racism covers offenses related to racist or xenophobic propaganda, including the dissemination, distributing or making available of racist and xenophobic material through the public through a computer system or Internet.

IT Security Act or ITSA for short) primarily exists in order to specify obligations for public and private entities based in Germany (or foreign entities that provide infrastructure in Germany) to implement adequate technical and organisational measures to protect and safeguard the availability, integrity, authenticity, and confidentiality of their IT systems.

Domain Grabbing: Domain names that contain or consist of protected signs of third parties are often applied for. Content then is reproduced on the websites that is connected to the

actions of the proprietor of these rights. This extends from defamatory content to so-called “sponsored links”.

Abuse: Domain names with signs of third parties are frequently

used for abusive and unlawful purposes (primarily occurring

with well-known trademarks).

Blocking: A third typical example is the targeted registration of domain names that include signs of third parties in order to prevent the proprietor of the corresponding rights to use the sign to acquire this domain himself. The aim of this approach is to sell the domain to the proprietor of the rights to use the sign at a later point in time, and regularly for excessive prices.
