What kind of remedy is available and which laws are applicable when there is an infringement of a protected trademark?

Section 14(5) (6) of the Trademark Act stipulates liability to the proprietor of a trademark and shall compensate for the damage incurred by the act of infringement. The compensation claim may be calculated on the basis of the amount which the infringer should have paid as a suitable remuneration if he/she had obtained authorization to use the trademark.

Which legal instruments contain the rules for e-commerce at the EU level and in Germany?

E-Commerce Directive 2000/31/EC of the European Parliament and the Council of 8 June 2000 on certain legal aspects of information society services in particular ecommerce,

in the Internal Market.  It was formally adopted on 17 July 2000.

The main purpose is to remove obstacles to cross-border online services across the EU and provide legal certainty to business and citizens in cross-border online transactions.

The legal framework on e-commerce is contained in the

following laws: E-Commerce Law (Elektronischer Geschäftsverkehr-Gesetz

EGG) of 14 December 2001 and came into force in January 1, 2002.

The law implements the European Directive on ECommerce and reforms the Teleservice Data Protection Act (Teledienstdatenschutzgesetz) and the Code of Civil Procedure (Zivilprozessordnung).

The following option are the fines contained in the German IT Security Law (IT Sicherheitgessetz)

a.      Fines up to 10 000 000 EUR or in the case of an undertaking, up to 2% of the worldwide annual revenue of the prior financial year, whichever results higher. Fines up to 20 000 000 EUR or in the case of an undertaking, up to 4% of the worldwide annual revenue of the prior financial year, whichever results higher.

b.      Fines up to 10 000 EUR for no cooperating with the law enforcement authorities.

c.       Both a fine of 500 000 EUR and an imprisonment of up to two years.

d.      Up to 50 000 EUR for telemedia service providers and up to 100 000 EUR for operators of critical infrastructure.

e.      The fines are calculated on the basis of the existent minimum weight salary of the country concerned.

The aim of this approach is to sell the domain to the proprietor of the rights to use the sign at a later point in time, and regularly for excessive prices.
