Die sog. Räumlichkeit muss zumindest vorübergehend der Wohnung von Menschen dienen, d.h als Mittelpunkt der privaten Lebensführung genutzt werden. Entscheidend ist hierbei die reale Widmung zum Wohnen, also die tatsächliche Nutzung als Wohnung. Die Eigenschaft wird nicht dadurch verloren, dass es diese Funktion in der Regel nur für eine gewisse Zeit erfüllt.

§306a normiert zwei Delikte: 1. §306a I, welches ein abstraktes Gefährdungsdelikt ist, das Menschen vor den allgemeinen Gefahren des Brandes schützten soll 2. §306a II, welches ein konkretes Gefährdungsdelikt ist. Hier ist doppelter Vorsatz erforderlich (Bzgl. Brand und konkreter Gefahr)
