What is the priniciple of sovereignty?
It says that there is no higher authority to which a state must obey.

How does the principle of sovereignty apply to tax legislation?
A state can therefore make any tax law which it wants to make. E.g. a state may tax people having a beard, a state may tax houses according to the number of windows, etc.

What is the main restriction when it comes to this sovereignty?
No state may apply its law to cases which have no effective connection with that state.

What are the conditions for the application of tax legislation?
1. Law may be applied if the PERSON has a connection to that state. 2. Law may be applied if the EVENT has a connection to that state.

What possible taxes exist?
1. Taxes on income = Taxes on the increase of your property (e.g. income tax, corporation tax, trade tax). 2. Taxes on wealth = Taxes on the property which you have on a certain date (e.g. wealth tax, inheritance tax, real estate tax). 3. Taxes on consume = taxes on the money which you spend (e.g. value added tax, tobacco tax, real estate transfer tax).

What is an indirect tax?
A tax where the legislator expects that the person who is, under the rules of the law, treated as the taxpayer (e.g. the seller of a product or service) will, in the end, transfer the financial burden of the tax to another person, e.g. by increasing the price of the product accordingly, and where this effect is even planned by the legislator.

Value Added Tax (VAT), tobacco tax, energy tax, coffee tax, tax on alcohol, etc.

What is the fundamental principle of indirect taxation?
Neutrality of competition. E.g. state must tax two suppliers of the same good exactly the same.

What are the consequences from the principle of neutrality of competition?
1. Taxation in the country of DESTINATION. All imported goods must be taxed and border controls are neccesary. 2. NO taxation in the country of ORIGIN. All exported goods must be free of tax.

Who and what is taxed when it comes to VAT?
All entrepreneurs (i.e. owners of a business, within the scope of their bsn activities) with all the goods and services they sell/render to customers, as far as these transactions are done "in the inland".

What is tax-free when it comes to VAT?
All exports and certain goods and services for social reasons (e.g. health care). (Every transaction that is taxfree must be EXPLICITLY named in the list of taxfree transactions, not just similar).

Name possible strategies as solutions for conflicts of different laws of different nations!
1. Coordination of legislation (+cooperation in application of law); keep different national laws, but coordinate the scope of their application. 2. Harmonization: The contents of the national laws are unified in a certain degree. 3. World-wide unification of law: the contents of the national laws are identical or legislation even shifted to an int. institution.
